ii <br />C[5uncil. Meet g, <br />May 27, 1980 <br />\ Page Four <br />Mayor Gourley called a recess at this point. Meeting to reconvene at 8:55 P.M. <br />The meeting was reconvened. Mayor Gourley noted that there are three requests <br />under the Planning and Zoning report - Mr. Smeed and Mr. Turene for keeping of <br />horses and Mr. Suchy for keeping animals - he suggested these requests be <br />tabled until the suggested ordinance is completed. He put this suggestion <br />to the persons affected and they agreed to the postponment. <br />Mr. McLean moved to approve the tabling of these three items Seconded by Mr. <br />Jaworski. Motion carried unanimously. <br />The Public Hearing on Wollan's Estates was called to order. Mayor Gourley asked <br />Mr. Schumacher to present the information on this request. Mr. Schumacher <br />read the notice of publication. <br />The application was for the rezoning from Commercial/Residential to Light Ind- <br />ustrail. This is for the four lots facing Lake Drive. This should have been <br />for a zoning of General Business. <br />This is for the rezoning of the entire lots 24,25,26, and 27 of Wollan's Estates <br />from Comm/Res to General Business. The park requirements for this land has been <br />taken care of for this property, <br />Mayor Gourley asked for comments from the audience, there was none. Mr. McLean <br />moved to approve this rezoning. Seconded by Mr. Kulaszewicz. <br />Mr. Locher said the meets and bounds description will have to be used for the <br />legal since this is not a filed plat. Legal descriptions that are not filed <br />cannot be used, so in order to rezone this , the meets and bounds description <br />of these lots must be used. <br />Mayor Gourley amended the motion to have the developer provide this description <br />for the Attorney. This was accepted. Motion carried unanimously. <br />Mr. Kulaszewicz moved to close the Public Hearing. Seconded by Mr. McLean. <br />Motion carried unanimously. 9:20 P.M. <br />On considering the Restrictive Ordinance, Mr. Locher reported t at e a had <br />problems in locating the exact State Statute. The Ordinance is not ready for <br />consideration at this meeting but is to be on the June 9, 1980 agenda. <br />The next item was the ponding areas in Sunset Oaks and there are some dis- <br />crepancies. There are some ponding areas thg7 are not included. This matter <br />was discussed with Mr. Stanley. Mr. Locher disagreed with the term "Ponding <br />area". He felt that the situation may change and there would be another use <br />of this land that would serve a different purpose. <br />Mr. McLean moved to table consideration of these ponding areas until the June <br />9, 1980 meeting. Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />The Public Hearing. for the rezoning for Rite -Way Waterproofing was called to <br />order at 9: 30 P.M. There was no representative present. Mr. Schumacher felt <br />this rezoning is necessary for the financing of their project. There was no <br />testimony from the audience. Mr. Schumacher read the legal notice of publicatio <br />Mr. Jaworski moved to continue this hearing to June 9, 1980 at 9:00 P.M. <br />Seconded by Mr. McLean. Motion carried unanimously. <br />
