ORDINANCE NO. 72 <br /> CITY OF LINO LAKES <br /> COUNTY OF ANOKA <br /> STATE OF MINNESOTA <br /> AN INTERIM ORDINANCE DECLARING A MORATORIUM ON SUBDIVISION AND BUILDING IN <br /> A PART OF THE CITY OF LINO LAKES . <br /> WHEREAS, the City Council of the City of Lino Lakes, Anoka County, Minnesota , <br /> is conducting studies and has , held a scheduled hearing for the purpose of <br /> considering amendment of its Comprehensive Plan : and <br /> WHEREAS, the City Council hereby determines that further residential <br /> development within an area of the City of Lino Lakes , bounded on the West <br /> by County State Aid Highway No . 14, on the North by Interstate Highway No. <br /> 35W, and by the North line of the City of Lino Lakes , on the East by the <br /> East line of the City of Lino Lakes , and on the South by the North lines of <br /> Sections 13, 14 and 15 , without benefit of said amended Comprehensive Plan <br /> is deemed to be detrimental to the lives and property of the owners thereof <br /> and others , as said area is essentially agricultural in usage and contains <br /> many low lying areas; and <br /> WHEREAS, The City Council deems it necessary that a moratorium be declared <br /> on said land for the immediate preservation of health and safety . <br /> NOW THEREFORE, the City Council of the City of Lino Lakes , Anoka County, <br /> Minnesota , ordains : <br /> I. <br /> A moratorium is hereby declared on any subdivision or building upon the <br /> following lands within the City of Lino Lakes : <br /> That part of Lino Lakes bounded on the West by County State Aid <br /> Highway No. 14, on the North by Interstate Highway No 35W, and by <br /> the North line of the City of Lino L4-rkes , on the West by the East <br /> line of, the City of Lino Lakes , and on the South by the North lines <br /> of -Sections 13,14, and 15 . <br /> II, <br /> This moratorium shall remain in effect until the Comprehensive Plan <br /> Amendment is approved by the Metropolitan Cojncil and the passage of 90 <br /> days thereafter, or one year from the date hereof, whichever is less . <br /> III. <br /> No building permits shall be granted for any construction on said lands <br /> during said moratorium, except upon prior hearing thereon and the granting <br /> of a written variance by the City Council . This interim ordinance shall <br /> not affect building permits issued prior to the date hereof. <br /> IV. <br /> This Ordinance shall be effective from and after its passage and publication <br /> according to law. <br /> Passed by the City Council this loth day of March 1980. <br /> F.
