ORDINANCE NO. 78 <br /> CITY OF LINO LAKES <br /> COUNTY OF ANOKA <br /> STATE OF MINNESOTA <br /> AN ORDINANCE DECLARING A MORATORIUM ON ALL METES AND BOUNDS SUBDIVISIONS <br /> WITHIN THE CITY OF LINO LAKES. <br /> WHEREAS, the City Council of the City of Lino Lakes , Anoka County, State <br /> of Minnesota , is conducting studies and has held a scheduled hearing for <br /> the purpose of considering amendments of its Comprehensive Plan, and <br /> WHEREAS, The City Council hereby determines that further metes and bounds <br /> subdivisions within the City of Lino Lakes without the benefit of said <br /> amendmended Comprehensive Plan is deemed to be determential to the lives <br /> and property of the owners thereof and other, and <br /> WHEREAS, large lot subdivisions would be detrimental in some areas to the <br /> extension of essential services , and <br /> WHEREAS, the City Council deems it necessary that a moratorium be declared <br /> on development on said land for immediate preservation of health and safety <br /> to allow the City to study the matter adequately . <br /> NOW THEREFORE, the City Council of the City of Lino Lakes , Anoka County, <br /> Minnesota , Ordains : <br /> A moratorium is hereby declared on any metes and bounds subdivision within <br /> the City of Lino Lakes . <br /> Variance may be granted for parcels of land five (5) acres in total area <br /> or greater and having a minimum of three Hundred (300) feet or more of <br /> frontage on an existing dedicated street , maintained by the City, except <br /> that the City Council may, in its sole discretion , grant variances for <br /> individual residential construction on the basis of what has become known <br /> as a lot split in appropriate situations . <br /> The following information shall be provided prior to a variance consideration . <br /> a) Certificate of survey; b) maps of adjacent wet lands; c) location of <br /> adjacent development within three hundred (300) feet; d) location of pro- <br /> posed development; e) any information required on normal preliminary plats <br /> which the City staff deems applicable; f) any other information the Council <br /> deems necessary. <br /> Park Dedication - all subdivision approved through the above stated variance <br /> procedure shall be required to ?sake a dedication to the Lino Lakes Park <br /> system in a manner prescribed in Ordinance No . 21B. <br /> This moratorium shall remain in effect until the Comprehensive Plan amend- <br /> ment is approved by th.e Metropolitan Council and the passage of ninety (90) <br /> days thereafter, or one (1) year from the date hereof, whichever is less . <br /> This Ordinance shall be effective from and after its passage and publication <br /> according to law. <br /> Passed by the City Council this 8th day of December, 1980 <br /> ATTEST:�� _ <br /> t <br /> Edna L.
