ORDINANCE NO. 78 <br /> ' CITY OF LINO LAKES <br /> COUNTY OF ANOKA P <br /> STATE OF MINNESOTA <br /> AN ORDINANCE DECLARING <br /> A MORATORIUM ON ALL <br /> METES AND BOUNDS SUB- <br /> DIVISIONS WITHIN THE CITY <br /> OF LINO LAKES. <br /> Whereas, The City Council of <br /> the City of Lino Lakes, Anoka <br /> County, State of Minnesota, is <br /> conducting studies and has held a <br /> scheduled hearing for the purpose <br /> of considering amendments of its <br /> Comprehensive Plan,and <br /> WHEREAS,The City Council <br /> hereby determines that further <br /> metes and bounds subdivisions <br /> within the City of Lino Lakes <br /> without the benefit of said amend- <br /> ed Comprehensive Plan is deemed <br /> to be detrimental to the lives and <br /> property of the owners thereof <br /> and others,and <br /> WHEREAS, large lot sub- <br /> divisions would be detrimental in <br /> some areas to the extension of <br /> essential services,and <br /> WHEREAS, the City Council <br /> deems it necessary that a mora- <br /> torium be declared on develop- <br /> ment on said land for the immed- <br /> iate preservation of health and <br /> safety to allow the City to study <br /> the matter adequately. <br /> NOW THEREFORE,the City <br /> Council of the City of Lino Lakes, <br /> Anoka County, Minnesota, Or- <br /> dains: <br /> A moratorium is hereby de- <br /> clared on any metes and bounds <br /> subdivision within the City of Lino <br /> Lakes. <br /> Variance may be granted for <br /> parcels of land five (5) acres in <br /> total area or greater and having a <br /> minimum of three hundred (300) <br /> feet or more of frontage on an f <br /> existing dedicated street, main- <br /> tained by the City,except that the <br /> City Council may, in its sole <br /> discretion, grant variances for <br /> individual residential construction <br /> on the basis of what has become <br /> known as a lot split in appropriate <br /> situations. <br /> The following information <br /> shall be provided prior to a <br /> variance consideration. a) Certifi- <br /> cate of survey;b)maps of adjacent <br /> wet lands; c) location of adjacent <br /> development within three hundred <br /> (300) feet; d) location of proposed <br /> development; e) any information <br /> required on normal preliminary <br /> plats which the City staff deems <br /> applicable; f) any other infor- <br /> mation the Council deems neces- <br /> sary. <br /> Park Dedication - all sub- <br /> divisions approved through the <br /> above stated variance procedure <br /> shall be required to make a <br /> dedication to the Lino Lakes Park <br /> system in a manner prescribed in <br /> Ordinance No.21B. <br /> This moratorium shall remain <br /> in effect until the Comprehensive I <br /> Plan amendment is approved by <br /> the Metropolitan Council and the <br /> passage of ninety (90) days there- <br /> after,or one(1)year from the date <br /> hereof,whichever is less. <br /> This Ordinance shall be effec- <br /> tive from and after its passage and <br /> publication according to law. <br /> Passed by the City Council <br /> this 8th day of December, 1980. <br /> F.Kenneth Gourley,Mayor- <br /> Edna L.Sarner <br /> Clerk-Treasurer <br /> Circulating Pines Dec. 11, 1980 <br />
