-)Lino Lakes City Counsil Members <br />Lino Lakes, Minnesota <br />Dear Council Members: <br />March 12, 1981 <br />In regard to the rezoning of Lake Drive scheduled for public hear- <br />ing, I would like to present some points to ponder before final action <br />is taken. <br />At the December, 1980 meeting of the Zoning Board, Mr. Karth was <br />instructed to contact each of the five homeowners residing within the <br />area planned for rezoning, and work out a suitable agreement for their <br />protection. He was asked to return with a report at the February, 1981 <br />meeting. The Board stated that they would act on the rezoning at that <br />time. Just before the February meeting I called Mr. Schumacher because <br />none of the residents had been contacted. He assured me that there would <br />be no action at the February meeting. There was action on a part of the <br />area, but the Zoning Board did not feel comfortable about the part be- <br />ing considered for heavy industrial. When Mr. Schumacher was questioned <br />abobt the instructions the Zoning Board had issued in December, he stated <br />it was not in the minutes. Mr. Bathke was not at the December meeting <br />so I have contacted him and discussed the matter with him, requesting <br />an investigation. <br />Subsequently, Counsil gave preliminary approval of the entire area, <br />even though the Zoning Board had expressed a desire to study the plan <br />more thoroughly. <br />We are sincerely hoping the City Counsil will be very cautious in <br />passing the rezoning without holding a tight reign on what is proposed <br />at a later date for the protection of the homeowners, and that new busi- <br />nesses being developed will be compatable with adjoining' property use. <br />On listening to discussion by Counsil at the preliminary approval, it is <br />felt that if sewer were brought in, such controlls might not be exercised. <br />Also the 75 ft. proposed buffer zone for residences might be inadequate <br />for some types of activity. The ordinance allows 200 ft. for light in- <br />dustrial and 300 ft. for heavy. <br />Since there is now letigation pending against the already exsisting <br />heavy industry, approval without careful consideration could very well <br />lead to further legal action. Please study the plan carefully and make <br />some provisions to protect homeowners. Counsil can prevent later head- <br />aches by looking to this need before passing a rezone. <br />Sincerely, <br />Mrs. Paul E.
