December 17, 1980 <br />planning & Zoning <br />,Page Three <br />Mr. Reinert made the following statement; "As Chairman , I exercise certain <br />prerogatives and one the them is in regard to the agenda in trying to make <br />thj.N an efficient operating board fully informed with all the facts so we <br />ca to a good job. That was my major concern about that particular item <br />being set up special." <br />The first item on the agenda was a special use permit application by <br />Gary Taylor for the construction of a pole building on his property along <br />Lake Drive North of Main STreet to be used for the purpose of old car <br />restoration and aused car sales lot. The land is currently zoned commercial <br />and the special use permit is for the construction of a building for <br />commercial use in an unsewered area. <br />Several of the residents had questions that were discussed. MRs. Schwankl <br />asked about the absence of the signatures of the surrounding property <br />pwners. There was discussion on the possibility of noise pollution. <br />Mr. Reinert asked Mr. Doocy to read Mr. Short's letter on this request. <br />Mrs. Schwankl moved to deny this request. Seconded by MR. Doocy. Mr. <br />Johnson asked to amend the motion to 'deny because this is not consistent <br />with the Comprehensive Plan' - Mrs, Schwankl refused the amendment. Mr. <br />Reinert asked for a second - Mr. Prokop seconded the amendment. The amend- <br />ment passed with Mr. Reinert casting the tie breaking vote. The original <br />motion carried. <br />There was a five minutes recess called at this point in time. <br />Th iext item on the agenda was a rezoning request by Mr. Glenn and Mr. Ray <br />Rehbein to create an Industrial Park on lands located South of I35W, West of <br />Lake Drive, North of Elm Street and East of 4th Avenue with the exception of <br />'the several residential parcels existing. There was a definite concern of <br />some sort of scredjing or a buffer zone for the existing residential lands. <br />Mrs. Reinhold pointed out there is current litagation with some of this land <br />and she didn't feel this rezoning request should be rail roaded through. <br />The Board asked that Mr. Karth present a more specific and detailed plan at <br />a subseque#tp P&Z meejfting. Mr. Johnson moved to table this rezoning request; <br />pending a more detailed layout being presented to the Board for consideration, <br />surrounding property owners to be notified by staff, per Mr. Reinert. Second- <br />ed by Mr. Prokop. Motion _carried. <br />Mr. James Livingston requested a variance for the split of a lot on the <br />corner of Sunrise and Fairmont. It was noted this is the only areas in the <br />City where lots of less that 1 acre and:150' frontage is allowed. Mr. Doocy <br />moved to recommend approve of this lot split. Seconded by Mr. Prokop. Mr. <br />Johnson asked to amend the motion to include ' this is being allowed because <br />of a precedent having been set' this amendment was accepted. Motion carried! <br />Mr. James Schilling had applied for a rezoning of the remaining portion of <br />Lino Industrial Park but no one was present.
