CITY OF LINO LAKES <br />RESOLUTION NO. 19-41 <br />RESOLUTION APPROVING DECLARATION OF RESTRICTIVE COVENANT FOR <br />MAIN STREET SHOPPES 2ND ADDITION <br />WHEREAS, City Resolution No. 19-09 approving the Final Plat for Main Street Shoppes 2" <br />Addition required an amendment to the existing Declaration of Driveway Easement; and <br />WHEREAS, the proposed Declaration of Restrictive Covenant places a restrictive covenant on <br />Main Street Shoppes 2" Addition prohibiting the conveyance of the property to a third party <br />until either an amendment to the Driveway Easement or a separate suitable reciprocal easement <br />is recorded against the property, providing reciprocal access and utility rights for the respective <br />owner(s) of the property. <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby approves the Declaration of Restrictive Covenant as executed by CM Properties 14, LLC. <br />Adopted by the Council of the City of Lino Lakes this 25th day ofMarch , 2019. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Maher and was duly seconded by Council Member Stoesz and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Maher, SToesz, Rafferty, Manthey, Reinert <br />The following voted against same: <br />none <br />Jeff Reinert, a . r <br />ATTEST: <br />Ju'aline Bartell, C y Clerk <br />
