Barton-Aschman Associates, Inc. <br />Note: <br />There appears to be a slight conflict between this section and 1001.23 of the <br />Subdivision Regulations which prohibits conveyence of land by meets and bounds <br />and parcels of less than 20 acres. This should be addressed and resolved in the <br />subdivision regulations. <br />3. Section 1005.05, Sudividion 3, Amendments and Rezonings. The procedures <br />established for amendents and rezoning should have the following item added after <br />number (6). <br />(7) Notice for the purpose, time and place of such public hearing shall be <br />published in the official newspaper of the city and mailed to the appropriate <br />property owners at least ten days prior to the public hearing. <br />4. Section 1005.05, Subdivision 4, Site and Building Plan Review, (page 42). It is felt <br />that the city may want to have some guarantee that the applicant for site and <br />building plan review construct what is agreed upon in the review process. This <br />could be done in a number of ways. The following is recommended. <br />(C) The applicant or the owner of the land affected by such sight and building <br />plan review shall submit to the city at the time of site and building plan <br />review application an amount not to exceed one percent of the overall <br />construction value of the property. The applicant shall upon completion of <br />site and building plan review, submit to the city an agreement that they will <br />cause all improvements called for in the site and building plan review to be <br />completed within the time specified by the city. Performance of such <br />contracts shall be secured by the amount submitted at application. <br />5. Section 1005.05, Subdivision 5, Conditional Use Permits, (page 45). The scheduling <br />and notice of Public Hearing should be amended in this section to add the <br />following: <br />(F) A Public Hearing on the conditional use permits shall be held by the Planning <br />Commission or the City Council. <br />(G) Notice of the purpose, time and place of such Public Hearing shall be <br />published in the official newspaper of the city and mailed to property owners <br />within 350 feet of the property in question at least ten days prior to the <br />Public Hearing. <br />(K) Conditional Use Permits --Filing. Following approval of the Conditional Use <br />Permit a certified copy thereof including legal description of the property <br />shall be filed with the County Recorder and/or Registrar of Title. <br />6. Section 1005.05, Subdivision 7, Variances and Appeals, (page 47). The following <br />should be added to the end of this subdivision. <br />(C) Following approval of the variances a certified copy thereof including a legal <br />description of the property shall be filed with the County Recorder or <br />Registrar of Title. <br />
