15 <br /> <br />provided in Section 305.12 (Appeals). <br /> <br />§ 305.10 ABANDONMENT <br /> <br />(1) Abandoned Small Wireless Facilities and Wireless Support Structures. Where <br />a Small Wireless Facility or Wireless Support Structure is not properly maintained <br />or has not been used for the primary purpose of providing Wireless Services for 12 <br />consecutive months, the Department may designate the Small Wireless Facility or <br />Wireless Support Structure as abandoned. The Department shall provide written <br />notice to a Permittee within 10 days of the Permittee’s Small Wireless Facility or <br />Wireless Support Structure being designated as abandoned. <br /> <br />§ 305.11 REMOVAL OF A SMALL WIRELESS FACILITY OR WIRELESS <br />SUPPORT STRUCTURE <br /> <br />(1) Removal Permitted. The Department may remove, at Permittee’s expense, or <br />require a Permittee to remove, any Small Wireless Facility or Wireless Support <br />Structure if: <br /> <br />(a) The Small Wireless Facility Permit or Wireless Support Structure Permit is <br />revoked under this Chapter or expires without renewal; or <br />(b) The Small Wireless Facility or Wireless Support Structure is designated by the <br />Department as abandoned under Section 305.10 (Abandonment). <br /> <br />(2) Notice to Permittee; Time to Remove. The Department shall provide written <br />notice to the Permittee that it must remove a Small Wireless Facility or Wireless <br />Support Structure under this section, including the reasons therefor. If the Permittee <br />does not remove the Small Wireless Facility or Wireless Support Structure within <br />30 days after the date of such notice, the Department may remove it at the <br />Permittee’s expense without further notice to the Permittee. <br /> <br />§ 305.12 APPEALS <br /> <br />(1) Appeal. An Applicant or Permittee may have the denial or revocation of a Small <br />Wireless Facility Permit, or fees and costs required by this Chapter reviewed, upon <br />written request, by the City Council or its designee. The City Council or its <br />designee shall act on a timely written request at its next regularly scheduled <br />meeting. A decision by the City Council or its designee affirming a denial, <br />revocation, or fee shall be in writing and supported by written findings establishing <br />the reasonableness of the decision. <br /> <br />§ 305.13 INSURANCE <br /> <br />(1) Minimum Coverage. The Department shall require that each Permittee maintain in <br />full force and effect, throughout the term of a Small Wireless Facility Permit, an <br />insurance policy or policies issued by an insurance company or companies
