CITY OF LINO LAKES <br />RESOLUTION NO. 19-61 <br />RESOLUTION APPROVING AN EXTENSION TO START CONSTRUCTION OF <br />DISTINCTIVE ELEMENTS TILE AND DESIGN, LLC <br />WHEREAS, on April 18, 2018, the City Council passed Resolution No. 18-36 approving a <br />conditional use permit for a Contractor Shop and Office for Distinctive Elements Tile and <br />Design, LLC; and <br />WHEREAS, the property is legally described as Lot 1, Block 2, Apollo Business Park No. 2; <br />and <br />WHEREAS, Section 1007.016(2)(k) states if construction has not begun within one (1) year <br />after the date of the conditional use permit, or if substantial construction has not taken place <br />within three (3) years after the date of issuance of the conditional use permit, the permit is void; <br />and <br />WHEREAS, the applicant was required to start construction of the building by April 2019; <br />however, due to family and financial issues, construction has been delayed; and <br />WHEREAS, the applicant is requesting a 12 month extension to start construction. <br />NOW, THEREFORE BE IT RESOLVED The City Council of The City of Lino Lakes <br />approves an extension to start construction of Distinctive Elements Tile and Design, LLC by <br />April 2020. <br />Adopted by the Council of the City of Lino Lakes this 28th day of May, 2019. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Manthey and was duly seconded by Council Member Maher <br />vote being taken thereon, the following voted in favor thereof: <br />Manthey, Maher, Rafferty, Stoesz, Reinert <br />The following voted against same: <br />none <br />ATTEST: <br />�Jul�a�nne Bartell, City Clerk <br />1 <br />Jeff Reinert ! . or <br />and upon <br />
