1st Reading: Publication: <br />2nd Reading: Effective: <br /> <br /> <br /> <br />CITY OF LINO LAKES <br />ORDINANCE NO. 06-19 <br /> <br />AN ORDINANCE AMENDING CITY CODE SECTION 1007 ALLOWING FOR <br />CONSTRUCTION OF RETAINING WALLS GREATER THAN 42” IN HEIGHT <br /> <br />The City Council of Lino Lakes ordains: <br />Section 1. Findings. The City Council finds that the construction of retaining walls greater <br />than 42” in height are regulated by the State Building Code and therefore it is not necessary to <br />prohibit construction thereof. <br />Section 2. Amendment. Lino Lakes City Code § 1007.001 (2) Definitions is amended as <br />follows: <br />RETAINING WALL. A wall not laterally supported at the top that resists lateral soil <br />load and other imposed loads. <br />Section 3. Amendment. Lino Lakes City Code § 1007.043 (18) is proposed to be amended as <br />follows: <br />(a) Permit Required. It is unlawful for any person hereafter to construct or cause to be <br />constructed or erected within the platted areas of the City, any fence or wall without <br />first making an application for and securing a permit. <br /> <br />Section 4. Amendment. Lino Lakes City Code § 1007.043 (18)(c) 4. is proposed to read as <br />follows: <br /> <br />h. No fence or wall shall be located within a drainage or utility easement without <br />written permission of the Zoning Administrator City Engineer and the filing <br />of an encroachment agreement. <br /> <br />Section 5. Effective Date. This Ordinance shall be effective from and after its passage and <br />publication according to the Lino Lakes City Charter. <br />Adopted by the Lino Lakes City Council this 8th day of April, 2019.
