CITY OF LINO LAKES RESOLUTION NO. 19-113 RESOLUTION APPROVING THE AMENDMENT TO THE JOINT POWERS AGREEMENT FOR THE EAST CEDAR STREET & 24TH AVENUE/ELMCREST AVENUE NORTH IMPROVEMENT PROJECT WHEREAS, the Joint Powers Agreement was previously executed for the East Cedar Street & 24th Avenue/Elmcrest Avenue North Improvement Project by the City of Lino Lakes on March 11, 2019, and by the City of Hugo on March 26, 2019; and WHEREAS, it is mutually understand and agreed by and between the City of Hugo and the City of Lino Lakes to amend the previously executed agreement as follows: REMOVE: WHEREAS, Hugo and Lino Lakes both agree to construct the proposed improvements in 2019; and, ADD: WHEREAS, bids were received on Thursday, August 15, 2019, and found to be unacceptable by both parties; and, WHEREAS, The City of Hugo and the City of Lino Lakes have mutually agreed to rebid the project in the fall, 2019, for construction in the spring, 2020. All other terms and conditions that are not hereby amended are to remain in effect for the duration of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes: 1. The Joint Powers Agreement between the City of Hugo and the City of Lino Lakes for the 24th Avenue/Elmcrest Avenue & East Cedar Street Roadway Improvement Project is amended. Adopted by the Council of the City of Lino Lakes this 23rd day of September, 2019.
