CITY OF LINO LAKES <br />RESOLUTION NO. 19-114 <br />RESOLUTION APPROVING EXTENSION OF THE PUD FINAL PLAN/FINAL PLAT <br />SUBMITTAL FOR NATURE'S REFUGE <br />WHEREAS, review and approvals of plats are governed by Minnesota Statutes and City of Lino <br />Lakes ordinances; and <br />WHEREAS, on June 25, 2018 the City passed Council Resolution No. 18-70 approving the <br />PUD Development Stage Plan/Preliminary Plat for a residential subdivision called Nature's <br />Refuge; and <br />WHEREAS, Section 1007.024(6)(h)7 states unless a Final Plan covering the area designated in <br />the Development Stage Plan as the first stage of the PUD has been filed within one (1) year from <br />the date the City Council grants Development Stage Plan approval, or in any case where the <br />applicant fails to file Final Plans and to proceed with development in accordance with the <br />provisions of this Ordinance and/or an approved Development Stage Plan, the approval shall <br />expire. The City Council may at its discretion extend for six month intervals the filing deadline <br />for any Final Plan when, for good cause shown, such extension is necessary; and <br />WHEREAS, Section 1001.055(2) states a complete application for final plat shall be submitted <br />no later than one year after the date of approval of the preliminary plat, or a time as provided in <br />the developer's agreement. Otherwise, the preliminary plat approval shall be considered void, <br />unless an extension is requested in writing and for good cause, is granted by the City Council; <br />and <br />WHEREAS, Preferred Builders, Inc. has requested a 6 month submittal extension while they <br />finalize HOA documents and wetland management plans. <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes, the <br />PUD Final Plan/Final Plat for Nature's Refuge shall be submitted by December 25, 2019 unless <br />an additional extension is granted by the City Council. <br />Adopted by the Council of the City of Lino Lakes this 9th day of September 2019. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member stoes z and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Rafferty, Stoesz, Maher, Manthey, Reiner <br />The following voted against same: <br />none <br />ATTEST: <br />Juli., e Bartell, City Cle <br />1 <br />Jeff Reinert, a ' or <br />
