CITY OF LINO LAKES <br />RESOLUTION NO. 19-113 <br />RESOLUTION APPROVING THE AMENDMENT TO THE JOINT POWERS <br />AGREEMENT FOR THE EAST CEDAR STREET & 24TH AVENUE/ELMCREST <br />AVENUE NORTH IMPROVEMENT PROJECT <br />WHEREAS, the Joint Powers Agreement was previously executed for the East Cedar Street & <br />24th Avenue/Elmcrest Avenue North Improvement Project by the City of Lino Lakes on March <br />11, 2019, and by the City of Hugo on March 26, 2019; and <br />WHEREAS, it is mutually understand and agreed by and between the City of Hugo and the City of <br />Lino Lakes to amend the previously executed agreement as follows: <br />REMOVE: <br />WHEREAS, Hugo and Lino Lakes both agree to construct the proposed <br />improvements in 2019; and, <br />ADD: <br />WHEREAS, bids were received on Thursday, August 15, 2019, and found to be <br />unacceptable by both parties; and, <br />WHEREAS, The City of Hugo and the City of Lino Lakes have mutually agreed to <br />rebid the project in the fall, 2019, for construction in the spring, 2020. <br />All other terms and conditions that are not hereby amended are to remain in effect for <br />the duration of the contract. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes: <br />1. The Joint Powers Agreement between the City of Hugo and the City of Lino Lakes for the <br />24th Avenue/Elmcrest Avenue & East Cedar Street Roadway Improvement Project is <br />amended. <br />Adopted by the Council of the City of Lino Lakes this 23rd day of September, 2019. <br />The motion for the adoption of the foregoing resolution was introduced by Council -tuber <br />Manthey and was duly seconded by Council Memb- ah r and upon <br />vote being taken thereon, the following voted in favor t - eof: <br />Manthey, Maher, Stoesz, Reinert <br />The following voted against same: <br />none (Absent -'Rafferty) <br />ATTEST: <br />Juliariii7ity i erk <br />Jeff Reine , " ayor <br />
