4 <br /> <br />3. The subdivision will result in a sewer extension consistent with Lino Lakes sewer plan <br />and capital improvement plan; <br />4. A rural subdivision can demonstrate that each lot can be served by an adequate sanitary <br />sewer disposal system; and <br />5. A rural subdivision with a proposed communal sanitary sewer or water system has an <br />effective long range management and maintenance program with proper financing. <br /> <br />Poehling Addition will be served with an adequate waste disposal system. In 2018, the City <br />commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct <br />the street and install municipal water and sanitary sewer. The subject site is served by a 3” <br />sanitary sewer force main and has capacity to handle one (1) single family home. <br /> <br />BE IT FURTHER RESOLVED by the City Council of The City of Lino Lakes hereby <br />establishes that Poehling Addition is not a premature subdivision; and <br /> <br />BE IT FURTHER RESOLVED by the City Council of The City of Lino Lakes hereby <br />establishes the following conditions of approval: <br /> <br />1. A basin and side yard drainage way are required to minimize stormwater and pollutants <br />from entering the public water. <br />2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 feet in <br />width but no less than 10 feet in width shall be installed and maintained on both Lot 1 <br />and Lot 2. <br />a. One access opening to the shoreline no greater than 20 feet wide is allowed on <br />Lot 1 and Lot 2. <br />3. The existing house on Lot 1 and new house on Lot 2 are required to connect to municipal <br />water and sanitary service upon availability. <br />4. Lot 1 and Lot 2 will have limited ability to construct accessory structures, decks or <br />additions due to the required OHWL setback and floodplain requirements. <br />5. The applicant shall obtain a FEMA LOMR-F to revise the floodplain map. <br />6. The OHWL setback on Lot 2 shall be the “BLDSG” line extending between the adjacent <br />house structures as shown on the preliminary plat; and <br /> <br />BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby <br />approves the preliminary plat for Poehling Addition subject to the following items being <br />addressed in conjunction with the final plat submittal: <br /> <br />1. All comments from City Engineer Letter dated September 24, 2019 shall be addressed. <br />2. All comments from the Environmental Coordinator letter dated August 6, 2019 shall be <br />addressed. <br />3. Sheet 2, Preliminary Plat: <br />a. It shall be noted on the preliminary plat and future certificate of surveys, “This lot <br />has limited ability to construct accessory structures, decks or additions due to the <br />required OHWL setback and floodplain requirements.” <br />b. The “BLDSB” line along the side yards shall be omitted. <br />c. The wetlands and FEMA basin shall be covered by a 10 foot wide easement. <br />d. A future deck location shall be shown on the future house on Lot 2. <br />4. Sheet 5, Utility As-Built Plan: <br />a. The size of the existing watermain and sanitary sewer main shall be indicated.
