SWIFT Contract Number 168971 <br />Between the Minnesota Department of Health and City of Lino Lakes <br /> <br />Page 2 of 9 <br />Standard Grant Template Version 2.3, 1/2019 <br /> <br />Minnesota Department of Health <br />Grant Agreement <br /> <br />This grant agreement is between the State of Minnesota, acting through its Commissioner of the <br />Department of Health ("State") and City of Lino Lakes ("Grantee"). Grantee's address is 600 Town <br />Center Parkway, Lino Lakes, Minnesota 55014. <br /> <br />Recitals <br /> <br />1. Under Minnesota Statutes 144.0742 and §114D.50 (Clean Water Fund) , the State is empowered to <br />enter into this grant agreement. <br /> <br />2. The State is in need of assisting public water suppliers to protect the source of drinking water. <br /> <br />3. The Grantee represents that it is duly qualified and will perform all the duties described in this <br />agreement to the satisfaction of the State. Pursuant to Minnesota Statutes section 16B.98, <br />subdivision 1, the Grantee agrees to minimize administrative costs as a condition of this grant. <br /> <br />Grant Agreement <br /> <br />1. Term of Agreement <br /> <br />1.1 Effective date November 15, 2019, or the date the State obtains all required signatures <br />under Minnesota Statutes section 16C.05, subdivision 2, whichever is later. <br />The Grantee must not begin work until this contract is fully executed and the State's <br />Authorized Representative has notified the Grantee that work may commence. <br /> <br />1.2 Expiration date April 30, 2022, or until all obligations have been fulfilled to the satisfaction <br />of the State, whichever occurs first. <br /> <br />1.3 Survival of Terms The following clauses survive the expiration or cancellation of this grant <br />contract: 8. Liability; 9. State Audits; 10.1 Government Data Practices; 10.2 Data Disclosure; 12. <br />Intellectual Property; 14.1 Publicity; 14.2 Endorsement; and 16. Governing Law, Jurisdiction, <br />and Venue. <br /> <br />2. Grantee's Duties The Grantee, who is not a state employee, shall: <br />• Edit existing groundwater model and create new scenarios to further study the impact(s) that <br />the newly implemented Well No. 6 and proposed Well No. 7 could have on the Drinking Water <br />Source Management Area (DWSMA) location and aquifer vulnerability. <br />• Conduct a public education campaign using existing communication devices such as the City’s <br />website and newsletters on the importance of turf management, proper lawn care, smart <br />salting, and water conservation. <br />• Conduct a Wellhead Protection Plan evaluation to determine the status of the City’s Wellhead <br />Protection Plan
