CITY OF LINO LAKES <br />RESOLUTION NO.19456 <br />RESOLUTION APPROVING THE SECOND AMENDMENT TO THE JOINT POWERS <br />AGREEMENT FOR THE EAST CEDAR STREET & 24TH AVENUE/ELMCREST <br />AVENUE NORTH IMPROVEMENT PROJECT <br />WHEREAS, the Joint Powers Agreement was previously executed for the East Cedar Street & <br />24th Avenue/Elmcrest Avenue North Improvement Project by the City of Lino Lakes on March <br />11, 2019, and by the City of Hugo on March 26, 2019; and <br />WHEREAS, the Joint Powers Agreement was previously amended by the City of Hugo on <br />September 3, 2019, and the City of Lino Lakes on September 23, 2019, to change the <br />construction schedule from 2019 to 2020; and <br />WHEREAS, it is mutually understand and agreed by and between the City of Hugo and the City of <br />Lino Lakes to amend the previously executed agreement as follows: <br />ADD: <br />WHEREAS, the City of Hugo has received indications there may be development <br />interest on a parcel adjacent to Elmcrest Avenue and the City of Hugo therefore <br />wishes to include a bid alternate for the extension of sanitary sewer and watermain <br />to said property; and <br />WHEREAS, all engineering invoices to prepare this bid alternate will be billed to <br />and paid for directly by the City of Hugo; and <br />All other terms and conditions that are not hereby amended are to remain in effect for <br />the duration of the contract. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes that the <br />Joint Powers Agreement between the City of Hugo and the City of Lino Lakes for the 24 <br />Wenue/Elmcrest Avenue & East Cedar Street Roadway Improvement Project is amended. <br />Adopted by the Council of the City of Lino Lakes this 9th day of December, 2019. <br />The motion for the adoption of the. foregoing resolution was introduced by Council.
