600 Town Center Parkway, Lino Lakes, MN 55014 <br />Phone: 651-982-2400 ∙ Fax: 651-982-2499 <br /> <br /> <br /> <br /> <br />Memorandum <br /> <br /> <br />To: Environmental Board Members <br /> <br />From: Katie Larsen, City Planner <br /> <br />Date: August 17, 2020 <br /> <br />Re: Land Use Application Process <br /> <br /> <br /> <br />At the July 29, 2020 Environmental Board meeting, board members asked about the <br />City’s Land Use Application process. <br /> <br />Land use decisions, developments and subdivisions in the City of Lino Lakes require <br />submittal of a Land Use Application. Examples include comprehensive plan <br />amendments, rezoning, conditional use permits, site plan review and subdivisions. State <br />Statute 15.99 requires governmental entities to approve or deny requests within 60 days <br />(aka the 60-day Rule). State statute allows 120 days for preliminary plat review. <br /> <br />Attached is a copy of the City’s Land Use Application which includes a fee schedule, <br />calendar of submittal deadlines and meeting dates for the City’s Advisory Boards <br />(Environmental, Parks, EDAC and Planning & Zoning). When planning staff receives a <br />Land Use Application, we review it to make sure the required information has been <br />submitted in order to deem the application complete. A complete application; however, <br />does not necessarily mean the plans meet all City ordinance requirements. It is now the <br />role of staff and the Advisory Boards to determine compliance with the City’s <br />Comprehensive Plan and ordinances. <br /> <br />Planning staff reviews the plans and presents their staff reports to their respective <br />Advisory Board. Staff and Board comments are summarized and presented to the <br />Planning & Zoning Board for final recommendation to the City Council. The Planning & <br />Zoning Board is the advisory board statutorily authorized to review land use applications <br />and typically hold public hearings. Recommendations often include items the applicant <br />needs to address or revise in their plans.
