The larger accessory structure near the arena appears to be in the Zone A floodplain. The <br />exact year of its construction is unknown; however, a CUP was approved in 1986 for the <br />riding stable arena so it could be assumed the large accessory structure was constructed in <br />that same time period and would have been subject to the 1982 FEMA floodplain <br />requirements. The 1982 FEMA map shows the large accessory structure out of the <br />floodplain. This structure would be considered legal non -conforming and subject to the <br />Zoning and Floodplain Ordinance non -conformities regulations. <br />Accessory Structures <br />The applicant currently has three (3) outside horse shelters approximately 1 Oft x 20ft. <br />Assuming each shelter can house 4 horses, the maximum numbers of shelters allowed <br />should be limited to either 3 or 6 depending on the final CUP approval. The shelters are <br />specific accessory structures associated with the operation of a commercial stable. <br />A zoning or building permit is required for any accessory structure construction. All <br />structures shall meet setback requirements and shall not be located in the front yards of <br />either parcel. <br />Signage <br />Per Chapter 1010: Signs, one sign with a maximum size of 6 square feet placed at least <br />10 feet from the property line is allowed without a permit. <br />Staff Concerns <br />See Attachment #6, Environmental Coordinator letter dated October 7, 2020 for a <br />detailed analysis. Staff identifies the following concerns: <br />• Wetlands and Floodplain <br />There are approximately 22 acres of wetlands and floodplain on the 25 acre site. This <br />limits the amount of upland area to operate a commercial stable, pasture farm animals <br />and properly manage manure waste. <br />MN State rules state that for manure application, a minimum setback of 300 feet from <br />protected wetlands is required. A 50 foot non-manured vegetated buffer can be used in <br />place of the 300 foot setback during non -winter months. A 50 ft wide vegetated buffer <br />from the wetland shall be maintained. <br />Manure shall not be stored or spread in the floodplain. Manure bins and/or manure <br />storage shall be located outside the floodplain. <br />• Animal Health <br />Con <br />
