• <br />• <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Watermark 3rd Addition PUD Final Plan/Final Plat subject to the following <br />conditions: <br />1. Outlot A is preserved as permanent Open Space and shall be improved by the <br />Developer in accordance with the approved plans and upon completion and <br />acceptance by the city, of such improvements, it shall be owned and maintained <br />by a Homeowner's Association in accordance with an approved Restoration and <br />Management Plan. <br />2. A separate fence permit is required for the fencing along CSAH 54 (20th Avenue). <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Development subject to the following items being addressed prior to release <br />of final plat mylars: <br />1. The 3rd Addition Development Agreement shall be approved by the City Council, <br />executed and recorded against the property. <br />a. The Development Agreement will include park dedication credit for the <br />platted private parks, Outlot K and Outlot I, Watermark. <br />2. Any staff comments requiring revisions to the final plat. <br />3. The title commitment shall be updated. <br />4. A draft copy of the deed for Outlot A shall be submitted to the City for review <br />and approval. <br />5. Draft copies of the applicable Homeowner's Association (HOA) documents shall <br />be submitted to the City for review and approval. <br />a. All applicable HOA documents shall be amended to include the revised <br />Open Space Maintenance Plan. <br />6. The Permanent Trail Easement with Description Sketch for the trail on Outlot A <br />shall be revised to include the trail section from the townhome neighborhood to <br />the south lot line. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Development subject to the following items being addressed prior to <br />issuance of building permit within the 3rd Addition: <br />1. All comments from the City Engineer Letter dated March 4, 2020 shall be <br />addressed. <br />2. All comments from Environmental Coordinator Memo dated March 4, 2020 shall <br />be addressed. <br />3. Copies of the recorded the Homeowner's Association (HOA) documents shall be <br />submitted to the City. <br />a. All applicable HOA documents shall be amended to include the revised <br />Open Space Maintenance Plan. <br />4. A copy of the recorded deed for Outlot A shall be submitted to the City. <br />5. A copy of the recorded Permanent Trail Easement with Description Sketch for the <br />trail on Outlot A and Townhome Neighborhood shall be submitted to the City. <br />6.
