• <br />• <br />• <br />CITY COUNCIL <br />AGENDA ITEM 6B <br />STAFF ORIGINATOR: Katie Larsen <br />MEETING DATE: May 26, 2020 <br />TOPIC: Consider Resolution No. 20-51 Approving Site <br />Improvement Performance Agreement for 617 Apollo <br />Drive (Muddy Cow) <br />VOTE REQUIRED: <br />BACKGROUND <br />3/5 <br />On April 13, 2020, Council approved Ordinance No. 03-20 amending the Marketplace Design <br />Guidelines to allow for building modifications for 617 Apollo Drive for the purpose of <br />constructing a restaurant with rooftop dining (Muddy Cow). Per Section 1007.020 Site and <br />Building Plan Review, a Site Improvement Performance Agreement is required. <br />(1) General. All site and building plans for multiple family, commercial, industrial or <br />public/semi-public uses shall require review and approval by the Community Development <br />Department. <br />(5) Performance Standards. (d) The applicant shall, upon completion of site and building plan <br />review, submit to the City an agreement that they will cause all improvements called for in the <br />site and building plan review to be completed within the time specified by the City. Performance <br />of such contracts shall be secured by the amount submitted at application or additional amount as <br />may be required by the City Council. <br />The attached Site Improvement Performance Agreement addresses the site improvements for the <br />building and provides for submittal of all required fees and securities. <br />RECOMMENDATION <br />Staff recommends approval of Resolution No. 20-51. <br />ATTACHMENTS <br />1.
