• 4. Conditions attached to approval of the preliminary plat have been fulfilled or secured by the Development Agreement. 5. All fees, charges and escrow related to the preliminary or final plat have been paid in full. BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby approves Stern Addition Final Plat subject to the following conditions: 1. A basin and side yard drainage way are required to minimize stormwater and pollutants from entering the public water. 2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 feet in width but no less than 10 feet in width shall be installed and maintained on both Lot 1 and Lot 2, Stern Addition. a. One access opening to the shoreline no greater than twenty (20) feet wide is allowed on both Lot 1 and Lot 2. b. The vegetated buffer zone shall be maintained in accordance with the recorded Shoreline Buffer Declaration and Maintenance Plan. c. The Shoreline Buffer Declaration shall be recorded against Lot 1 and Lot 2, Block 1, Stern Addition. 3. The existing house on Lot 2 and the new house on Lot 1 are required to connect to municipal water and sanitary service upon availability. 4. The existing septic system and private well on Lot 2 shall be properly removed, sealed and approved by the City prior to the issuance of a single family home building permit on Lot 1. 5. Lot 1 and Lot 2 will have limited ability to construct accessory structures, decks or additions due to the required OHWL setback and floodplain requirements. 6. The applicant shall obtain a FEMA LOMR-F to revise the floodplain map. 7. The applicant shall submit a completed CLOMR-F application prior to release of plat for recording. 8. An approved CLOMR — F will be required before issuing a building permit. 9. A LOMR-F will be required prior to Certificate of Occupancy. BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby approves the Stern Addition Final Plat subject to the following items being addressed: 1. The Development Agreement shall be approved by the City Council, executed and recorded against the property. a. Securities and fees shall be paid. 2. A copy of the recorded Shoreline Buffer Declaration shall be provided to the City. 3. The City Attorney shall review the status of title/property ownership related to the final plat prior to release of the final plat. 4. The applicant shall submit a completed CLOMR-F application prior to release of plat for recording. 5. Any comments from the City Engineer letter dated March 31, 2020 shall be addressed. 6. Any comments from the Environmental Coordinator letter dated March 31, 2020 shall be addressed.
