• <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Stern Addition Final Plat subject to the following conditions: <br />1. A basin and side yard drainage way are required to minimize stormwater and <br />pollutants from entering the public water. <br />2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 <br />feet in width but no less than 10 feet in width shall be installed and maintained on <br />both Lot 1 and Lot 2, Stern Addition. <br />a. One access opening to the shoreline no greater than twenty (20) feet wide <br />is allowed on both Lot 1 and Lot 2. <br />b. The vegetated buffer zone shall be maintained in accordance with the <br />recorded Shoreline Buffer Declaration and Maintenance Plan. <br />c. The Shoreline Buffer Declaration shall be recorded against Lot 1 and Lot <br />2, Block 1, Stern Addition. <br />3. The existing house on Lot 2 and the new house on Lot 1 are required to connect to <br />municipal water and sanitary service upon availability. <br />4. The existing septic system and private well on Lot 2 shall be properly removed, <br />sealed and approved by the City prior to the issuance of a single family home <br />building permit on Lot 1. <br />5. Lot 1 and Lot 2 will have limited ability to construct accessory structures, decks <br />or additions due to the required OHWL setback and floodplain requirements. <br />6. The applicant shall obtain a FEMA LOMR-F to revise the floodplain map. <br />7. The applicant shall submit a completed CLOMR-F application prior to release of <br />plat for recording. <br />8. An approved CLOMR — F will be required before issuing a building permit. <br />9. A LOMR-F will be required prior to Certificate of Occupancy. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Stern Addition Final Plat subject to the following items being addressed: <br />1. The Development Agreement shall be approved by the City Council, executed <br />and recorded against the property. <br />a. Securities and fees shall be paid. <br />2. A copy of the recorded Shoreline Buffer Declaration shall be provided to the City. <br />3. The City Attorney shall review the status of title/property ownership related to the <br />final plat prior to release of the final plat. <br />4. The applicant shall submit a completed CLOMR-F application prior to release of <br />plat for recording. <br />5. Any comments from the City Engineer letter dated March 31, 2020 shall be <br />addressed. <br />6. Any comments from the Environmental Coordinator letter dated March 31, 2020 <br />shall be addressed. <br />
