• <br />• <br />• <br />Currently, only 12.5 animal units are allowed. If the CUP and a waste management plan are <br />approved, a maximum of 25.0 animal units would be allowed. <br />Grading Plan and Stormwater Management <br />Although a grading plan and stormwater management plan is not specifically required for the <br />conditional use permit application, all efforts shall be made to prevent manure waste and runoff <br />from draining into ditches and wetlands. <br />Public Utilities <br />The house and arena are served by private well and septic system. The applicant shall provide <br />documentation that the septic system and drain field have been inspected and determined to be <br />in compliance with state requirements and sized for intended use. It should also be noted that <br />any future improvements required for restrooms shall be ADA compliant. <br />Landscaping and Tree Preservation Plan <br />Landscaping and tree preservation is not required for the commercial stables operation. <br />Wetlands <br />Wetlands are located on all three (3) parcels. An approved wetland delineation is not required <br />for the conditional use permit application; however, Rice Creek Watershed District (RCWD) <br />may require one. The applicant has been working with RCWD and the City regarding the <br />potential need for restoration of the wetlands on the site that were previously filled. The <br />subject site shall be in compliance with all City and other regulatory agency requirements or <br />the conditional use permit may be revoked. <br />Floodplain <br />The 2015 DFIRM indicates Zone A floodplain on all three (3) parcels. It appears the existing <br />house, smaller accessory structures and arena are not within the floodplain. The larger <br />accessory structure near the arena appears to be in the Zone A floodplain. The exact year of its <br />construction is unknown; however, a CUP was approved in 1986 for the riding stable arena so <br />it could be assumed the large accessory structure was constructed in that same time period and <br />would have been subject to the 1982 FEMA floodplain requirements. The 1982 FEMA map <br />shows the large accessory structure out of the floodplain. This structure would be considered <br />legal non -conforming and subject to the Zoning and Floodplain Ordinance non -conformities <br />regulations. <br />Accessory Structures <br />The applicant currently has three (3) outside horse shelters approximately 10ft x 20ft. <br />Assuming each shelter can house 4 horses, the maximum numbers of shelters allowed should <br />be limited to either 3 or 6 depending on the final CUP approval. The shelters are specific <br />accessory structures associated with the operation of a commercial stable. <br />5 <br />
