• <br />• <br />1st Reading: <br />March 23, 2020 <br />Publication: April 21, 2020 <br />2'' Reading: <br />April 13, 2020 <br />Effective: May 21, 2020 <br />CITY OF LINO LAKES <br />ORDINANCE NO. 03-20 <br />ORDINANCE AMENDING MARKETPLACE PLANNED DEVELOPMENT <br />OVERLAY (PDO) DESIGN GUIDELINES ORDINANCE NO. 03-05 RELATED <br />TO 617 APOLLO DRIVE (RETAIL B BUILDING) <br />The City Council of Lino Lakes ordains: <br />Section 1: Findings of Fact <br />1. The City received a Land Use Application to amend the Marketplace Planned <br />Development (PDO) Design Guidelines Ordinance No. 03-05. <br />2. Ordinance No. 03-05 is an amendment to the original PDO Ordinance No. 16-01. <br />3. Ordinance No. 03-05 regulates site plan and design guidelines for the Marketplace <br />development. The design guidelines detail requirements for site plan, building <br />composition, materials, lighting, signage, landscaping and building elevations. <br />4. The applicant is proposing to construct a restaurant with rooftop dining that will <br />require modifications to the site plan and building elevations. <br />5. Per the 2001 Marketplace Site Plan, the subject site is the Retail B building. <br />6. Ordinance No. 03-05 states under Special Provisions #4 that substantial <br />departures from the approved plans will require an amendment to the Planned <br />Development Overlay (PDO). <br />7. The Planning and Zoning Board held a public hearing on March 11, 2020. <br />8. Per City Zoning Ordinance Section 1007.015(5), the Planning and Zoning Board <br />shall consider possible adverse effects of the proposed ordinance amendment. Its <br />judgement shall be based upon, but not limited to, the following factors: <br />(a) The proposed action has been considered in relation to the specific policies <br />and provisions of and has been found to be consistent with the official City <br />Comprehensive Plan. <br />The existing retail business and proposed restaurant are consistent with the City's <br />Comprehensive Plan in regards to resource management, land use, housing, economic <br />development, transportation, sanitary sewer and water supply plan and community <br />1 <br />
