<br />Dear Mrs. Sarner:
<br />We note the above -named person has been reported as a
<br />member of the Public Employees Police and Fire Fund, and
<br />is shown as a part time police officer on duly signed
<br />Form 2, Personnel Report of New Employees.
<br />Under the provisions of Minnesota Statutes, Section 353.64,
<br />Subdivision 1 and 4, any employee serving on less than a
<br />full time basis as a police officer shall become a member
<br />of the Public Employees Police and Fire Fund, only after
<br />a resolution is adopted by the governing body of the
<br />employing governmental unit, declaring that the position
<br />such person holds is that of a police officer. A copy of
<br />such resolution showing appointment and duties of the person
<br />so employed must be filed with the PERA Board of Trustees and
<br />shall be irrevocable. If such resolution is not adopted, the
<br />part time police officer is required to become a member of the
<br />Coordinated Fund wtth Social Security coverage.
<br />Will you please let us know whether or not a resolution as just
<br />referred to has been adopted. If so, will you furnish our
<br />office with a copy. When we have details from you, we will
<br />be in a position to determine under which fund the employee
<br />in question will be enrolled.
<br />We will appreciate hearing from you as soon as possible so
<br />that this pending matter may be disposed of without delay.
