Miller <br />-2- November 2, 1967 <br />Former owners of the E2 of Lots 9 and 10, Block 6 were <br />James E. and Ruth Pierce, and the owner of Lot 12, Block 8, <br />was Suburban Properties Inc. The names listed are the <br />owners prior to the tax forfeiture to the State of Minnesota. <br />If the village council is interested in either of these parcels, <br />for village purposes, the matter should be brought to the <br />attention of the County Board as soon as possible, otherwise <br />the same will be sold at the next tax forfeiture sale. <br />You must certify to the County Auditor when you return the <br />forms that were mailed by the Auditor to you, of the fact <br />that there are special assessments outstanding and the amounts <br />thereof, although they are listed in the Auditor's office. <br />It is indeed possible that there may be other parcels of <br />property that have tax delinquencies on them, in the Village <br />of Lino Lakes. However, the delinquencies are not to the <br />point where the properties have gone forfeit to the State of <br />Minnesota. The only way that an exact check can be made <br />would be to go through the Auditor's Books, page by page, <br />for all of the lands within the Village of Lino Lakes. This <br />would be a tremendous task and then there would be no guarantee <br />that the property could be purchased as the owners do have a <br />right to pay the delinquent taxes and to have the title cleared <br />on the property. <br />In the event that the village determines to purchase the <br />parcels that have been forfeited to the State of Minnesota, <br />then there must be a state deed issued from the State of <br />Minnesota, and the title on the property would be unmarket- <br />able due to the tax forfeiture. However, as the lands would <br />be used for village purposes, it would probably be unnecessary <br />to clear the title by a costly Quiet Title Action or a Torrens <br />Proceeding unless the council felt that there was some irregu- <br />larity in the tax forfeiture procedure. <br />I would suggest that you bring this matter up at the council <br />meeting of November 13, 1967. <br />C7 <br />Landol(Y Locher <br />erb <br />encs <br />
