Chapter VIII, Section 8.06. <br />Motion by Kay Murphy, second by Robert Rud to revise Charter as <br />follows: Carried. <br />Section 8.06. When under the provisions of Section 8.04, <br />Subdivision 1, an improvement is petitioned for by 80% of the <br />benefited property owners, such property owners may after the <br />mailing of notice of public hearing and public hearing, petition <br />to waive fifty (50) of the sixty (60) day waiting period. After <br />such petition, the City Council may immediately order the proposed <br />project. <br />Chapter VIII, Section 8.07. <br />Motion by Wally Ostlie, second by Eugene Bloomquist to accept <br />amendment to 8.07 as proposed by Ron Stahlberg in a memo to Randy <br />Schumacher dated October 10, 1987. Carried. Amendment to read as <br />follows: <br />Section 8.07. When under the provisions of Section 8.04, <br />Subdivision 1, an improvement is petitioned for by a majority of <br />the benefited property owners and the low bid received exceeds the <br />engineer's estimate by ten percent, such property owners may <br />petition the City Council to proceed with the project. After such <br />petition, the City Council may immediately award the proposed <br />project. <br />Section 8.04, Subdivision 3. <br />Mr. Stahlberg had recommended a revision to Subdivision 3. Motion <br />by Kay Murphy, second by Jerry Hanson to reject the proposed <br />amendment and leave Subdivision 3 as is stated in the City <br />Charter. Carried. <br />Mayor Ben Benson had indicated a matter of Council Members who <br />wish to file for election as Mayor but still have two years left <br />of term in office. Mr. Schumacher, having researched this issue, <br />stated as covered in Article 7, Section 6 of the State <br />Constitution, to request and individual to resign if running for <br />office is unconstitutional. <br />
