5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Poehling Addition Final Plat subject to the following conditions: <br />1. A vegetated buffer zone extending upland from the shoreline averaging at least 20 <br />feet in width but no less than 10 feet in width shall be installed and maintained on <br />both Lot 1 and Lot 2, Block 1, Poehling Addition. <br />a. One access opening to the shoreline no greater than twenty (20) feet wide <br />is allowed on both Lot 1 and Lot 2. <br />b. The vegetated buffer zone shall be maintained in accordance with the <br />recorded Shoreline Buffer Declaration and Maintenance Plan. <br />c. A Shoreline Buffer Declaration shall be recorded against Lot 1 and Lot 2, <br />Block 1, Poehling Addition. <br />2. Lot 1, Block 1, Poehling Addition shall be connected municipal sewer and water. <br />Lot 2, Block 1, Poehling Addition shall be connected through the building permit <br />approvals. The existing septic system and private well serving Lot 1, Block 1, <br />Poehling Addition shall be properly removed and or abandon, sealed and <br />approved by the City. <br />3. Lot 1 and Lot 2, Block 1, Poehling Addition will have limited ability to construct <br />accessory structures, decks or additions due to the required OHWL setback and <br />floodplain requirements. <br />4. Resolution No. 19-144 approving the lot area variance and Resolution No. 19-145 <br />approving the street setback variance shall be recorded against both parcels. <br />5. A LOMR-F will be required prior to Certificate of Occupancy. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Poehling Addition Final Plat subject to the following items being addressed: <br />1. Any comments from the City Engineer letter dated October 28, 2020 shall be <br />addressed. <br />2. The Developer shall submit a completed CLOMR-F application to the City prior <br />to release of plat for recording. <br />3. Mortgage consent is required for recording the final plat and Development <br />Agreement. <br />4. The Development Agreement shall be approved by the City Council, executed <br />and recorded against the property. <br />a. Securities and fees shall be paid. <br />5. A copy of the recorded Shoreline Buffer Declaration shall be provided to the City <br />prior to issuance of a grading and/or building permit. <br />6. Copies of the recorded variance resolutions shall be provided to the City prior to <br />issuance of a grading and/or building permit. <br />Adopted by the Council of the City of Lino Lakes this 14t" day of December, 2020. <br />2 <br />
