DATE: August 5, 2020 <br />TO: Park Board Members <br />FROM: Rick DeGardner, Public Services Director <br />RE: Aspen Lane Park Property <br />The Oaks of Lino subdivision was platted in in 1995. The official plat consists of nine residential lots <br />and an approximately 301' x 15' wide strip of property designated as "PARK" (see attached). The <br />intent of the Park property was to provide a potential trail connection when the property directly <br />south was developed. <br />The Saddle Club - First Addition was platted in 2014. During the planning phase, it was determined <br />that a public trail connecting the two developments was not warranted. The 2030 Comprehensive <br />Plan does not indicate a trail in this specific location. <br />Staff has identified three options related to the strip of park land: <br />• Retain the Property as Designated "Park" <br />• Construct a Public Trail <br />• Vacate the Property <br />Retain the Property as Designated "Park" —The adjoining property owners have mowed, watered, <br />raked, fertilized, etc. the city -owned parkland for many years (see attached). It has been well - <br />maintained and has functioned as an extension of the adjacent properties. For example, a fire pit <br />and landscaping have been installed, and a trailer/ATV's have been driven on the park property to <br />access one of the back yards. There are some potential liability issues knowingly allowing non -city <br />staff to maintain public property or permitting trailers and motorized vehicles. <br />Construct a Public Trail — A 8' wide asphalt trail could be installed to provide a trail connection <br />between the Oaks of Lino and Saddle Club developments. Estimated project costs are $25,000. <br />This would accomplish the original purpose for which the 'PARK" was originally dedicated. <br />Vacate the Property —The City would vacate the property, resulting in each adjacent property <br />obtaining possession of the nearer % of the 15' wide strip of land (7 %2 feet each). The City Attorney <br />would prepare the quit claim deeds and other legal documents that would be recorded with <br />
