CITY COUNCIL <br />AGENDA ITEM 5A <br />STAFF ORIGINATOR: Rick DeGardner, Public Services Director <br />MEETING DATE: January 25, 2021 <br />TOPIC: Oaks of Lino Park Property <br />i) Consider 2nd Reading of Ordinance No. 01-21, Vacating <br />Oaks of Lino Park Property <br />*Council may vote to dispense with the full reading of the ordinance <br />*Roll call vote is required for adoption of the ordinance <br />ii) Consider Resolution No. 21-03, Approving Summary <br />Publication of Ordinance No. 01-21 <br />iii) Consider Resolution No. 21-04, Authorizing the <br />Conveyance of Land (Park, Oaks of Lino) to Adjacent <br />Property Owners <br />VOTE REQUIRED: 4/5 <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 2nd reading of Ordinance No. 01-21 <br />Vacating Oaks of Lino Park property. <br />BACKGROUND <br />At the August 5, 2020 Park Board meeting, the Board discussed vacating the Oaks of Lino trail <br />corridor located between 992 and 998 Aspen Lane. The parcel is legally described as Park, <br />Oaks of Lino. The Board recommended to the City Council the Park be vacated. <br />ANALYSIS <br />The January 11, 2021 Council staff report includes the Park Board staff report and minutes that <br />provide more background and analysis. <br />Section 12.05 of the City Charter requires that the real property of the City cannot be disposed <br />of except by Ordinance. The Ordinance will require two readings, publication, and a waiting <br />period before it is in effect. The property will be conveyed to the adjacent property owners as <br />detailed in Resolution No. 21-04. <br />1 <br />
