Squires

Lino Lakes Training
March 10, 2021

I. THE LEGAL BASIS TO REGULATE LAND USE

A. Statutory basis for power to zone.

1. The authorization for the exercise of zoning is the police power. The police power
allows government to regulate individual conduct for the common welfare of the
community. The police power is inherent in the State, not local government. Thus,
the only power cities have is that delegated to them by the State.

a. The power to zone is established in Minn. Stat. § 462.351 et. seq.
