1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6B <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: March 22, 2021 <br /> <br />TOPIC: PUBLIC HEARING: Consider 1st Reading of Ordinance No. <br />02-21, Vacating Right-of-Way and Drainage & Utility Easement, <br />Lot 1, Block 4, Mar Don Acres <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the 1st Reading of Ordinance No. 02-21, <br />vacating Right-of-Way and Drainage and Utility easement, Lot 1, Block 4, Mar Don Acres. <br /> <br />BACKGROUND <br /> <br />7869 Meadow View Trail is a residential parcel located on the west side of Meadow View Trail <br />and the south side of Lois Lane. The property owners, George and Jenelle Slater, have <br />submitted a land use application requesting the vacation of a portion of the Lois Lane right-of- <br />way and the vacation of a drainage easement on the property. <br /> <br />The right-of-way and drainage and utility easement were dedicated to the City of Lino Lakes in <br />1978 with the Mar Don Acres plat. At the time of the plat, Lois Lane ended in a cul-de-sac on <br />the north side of 7869 Meadow View Trail. The current owners, George and Jenelle Slater, <br />would like the right-of-way originally platted to encompass the cul-de-sac to be vacated now <br />that Lois Lane extends to the west. The applicant is requesting that the portion of the drainage <br />easement adjacent to the right-of-way also be vacated. <br /> <br />The proposed right-of-way and easement vacation does not impact City roadway, utilities or <br />drainage. <br /> <br />The Street Vacation Exhibit prepared by E.G. Rud & Sons, Inc. and received on February 10, <br />2021, details the proposed right-of-way and drainage and utility area to be vacated. Concurrent <br />to the vacation process, the applicant will be required to record a city standard 10-ft drainage <br />and utility easement. <br /> <br />The second reading of the ordinance is scheduled for April 12, 2021. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 1st Reading of Ordinance No. 02-21 Vacating Right-of- <br />Way and Drainage & Utility Easements, Lot 1, Block 4, Mar Don Acres.
