Regulating the number of driveways and implementing access management practices are <br /> standard zoning and traffic safety tools. They serve a number of purposes including: <br /> oo Minimize conflicts and accidents with vehicle,pedestrian and bicycles using street. <br /> • Preserve areas for on-street parking. <br /> o In an August 25, 2020 email between the applicant and Diane Hankee, City <br /> Engineer, the applicant states, "If there is any way I could be allowed to have a 10 <br /> foot wide driveway from my new garage to Pinto Lane,please let me know. For <br /> the past couple years, I have been having issues with one neighbor who parks his <br /> work truck everyday in front of my 10' gate that I use to access my back yard <br /> from Pinto Lane. He refuses to move it when I ask him to which causes me to <br /> have to watch for him to be at work so I can get into my back yard with a vehicle. <br /> I would be more than willing to use any surface you would require for this <br /> driveway if allowed to have one." <br /> o There are currently conflicts with on-street parking and the illegal driveway. <br /> • Minimize impact and maintenance costs to public right-of-way and utility corridors. <br /> o An analysis by WSB on recent street reconstruction projects indicate driveway <br /> replacement costs range from$2,000 to $5,000 per driveway. <br /> • Maintain yard green space and enhance the streetscape. <br /> • Preserve street snow storage. <br /> • Minimize impervious surfaces. <br /> CRITERIA AND FINDINGS OF FACT <br /> Per City Zoning Ordinance Section 1007.018(1)(a): No variance shall be granted unless it meets <br /> all the criteria in paragraphs 1. through 7. below. The City shall make findings regarding <br /> compliance with these criteria. <br /> 1. The variance shall be in harmony with the general purposes and intent of the ordinance. <br /> The general purpose and intent of the Off-Street Parking ordinance is to alleviate or prevent <br /> congestion of the public right-of-way and to promote the safety and general welfare of the <br /> public, by establishing minimum requirements for off-street parking of motor vehicles upon <br /> various parcels of land or structures. <br /> The variance to allow for a second curb cut/driveway access is not harmonious with the general <br /> purposes and intent of the ordinance because it increases public right-of-way congestion, <br /> decreases safety and diminishes the general welfare of the public. <br /> 2. The variance shall be consistent with the comprehensive plan. <br /> Per the 2040 Comprehensive Plan, the property is guided for Low Density Residential land use. <br /> 4 <br />
