1st Reading:3/22/2021 Publication: 4/20/2021 <br /> 2nd Reading:4/12/2021 Effective: 5/20/2021 <br /> CITY OF LINO LAKES <br /> ORDINANCE NO. 02-21 <br /> ORDINANCE VACATING RIGHT-OF-WAY AND DRAINAGE AND UTILITY <br /> EASEMENT <br /> (Lot 1,Block 4,Mar Don Acres) <br /> The City Council of Lino Lakes ordains: <br /> Section 1: Findings of Fact <br /> 1. The City Council of Lino Lakes has determined to vacate a portion of the Lois <br /> Lane street right-of-way dedicated over, under, and across Lot 1, Block 4, MAR <br /> DON ACRES, as shown in Exhibit A and legally described as follows: <br /> That part of Lois Lane as dedicated on the plat of Mar Don Acres,Anoka County, <br /> Minnesota,which lies southerly of the westerly extension of the most northerly <br /> line of Lot 1, Block 4 said Mar Don Acres; and <br /> 2. The City Council of Lino Lakes has determined to vacate a portion of the <br /> drainage and utility easement dedicated over, under, and across Lot 1, Block 4, <br /> MAR DON ACRES, as shown in Exhibit A and legally described as follows: <br /> That portion of the drainage and utility easement as dedicated on Lot 1, Block 4, <br /> Mar Don Acres,Anoka County, Minnesota,which adjoins and lies southerly of <br /> the 60 foot radius right of way for Lois Lane, as dedicated on said plat of Mar <br /> Don Acres, except the westerly 10 feet thereof.; and <br /> 3. A public hearing was held on March 22, 2021 before the City Council in the City <br /> Hall Council Chambers after due published and posted notice had been given and <br /> reasonable attempts were made to give personal notice to all affected property <br /> owners, and all persons interested were given an opportunity to be heard: and <br /> 4. It appears to be in the best interest of the City to vacate such street right-of-way <br /> and drainage and utility easements; and <br /> 5. The Right-of-Way and Drainage and Utility Easement Vacation shall be recorded <br /> through Anoka County Recorder's Office; and <br /> 6. Four-fifths of all members of the City Council concur with this ordinance. <br /> 1 <br />
