CITY OF LINO LAKES <br /> RESOLUTION NO.21-30 <br /> RESOLUTION APPROVING CONSENT TO ENVIRONMENTAL COVENANT AND <br /> EASEMENT,LINO LAKES MINI STORAGE <br /> (440 PARK COURT) <br /> WHEREAS, on September 10, 2018,the City approved the site improvements and Conditional <br /> Use Permit for the Lino Lakes Mini Storage project at 440 Park Ct; and <br /> WHEREAS,the project site was identified to have buried debris possibly containing the <br /> hazardous materials, and <br /> WHEREAS,the site has been improved under the regulations of the Minnesota Pollution <br /> Control Agency(MPCA).A MPCA approved Response Action has been prepared for the site, <br /> and <br /> WHEREAS,the MPCA requires the owner, Lariat Companies, Inc.,to enter into an <br /> Environmental Covenant and Easement Agreement with their agency to maintain environmental <br /> restrictions; and <br /> WHEREAS,the City of Lino Lakes holds a Drainage and Utility easement over thq westerly <br /> portion of this site. The restricted area overlaps the City's easement area, and the City is asked to <br /> consent to the Environment Covenant restriction in the overlapping area. <br /> NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Lino Lakes <br /> Consents to the Environmental Covenant and Easement. <br /> Adopted by the Council of the City of Lino Lakes this 12th day of April, 2021. <br /> The motion for the adoption of the foregoing resolution was introduced by Councilmember <br /> Stoesz,was duly seconded by Councilmember Ruhland and upon vote being taken thereon, the <br /> following voted in favor thereof: Stoesz, Ruhland, Cavegn,Lyden, Rafferty <br /> The following voted against same: None <br /> ♦ <br /> 4 1y-. <br /> Rob Rafferty, Mayor <br /> AT PEST: <br /> Aor <br /> A! <br /> e Bartell, C ty Cle <br />
