[[rr-N Northwest ,associated Consultants , lne . <br /> U R 9 A K PLANNI N G • OESI C N • MARKET RESEARCH <br /> MEMORANDUM <br /> TO: Marty Asleson <br /> FROM: Bob Kirmis <br /> DATE: 30 October 1992 <br /> RE: Lino Lakes - Living Waters Church <br /> FILE NO: 194. 01 - 92 .45 <br /> At your request, I have reviewed the City Subdivision ordinance in <br /> regard to any park/trail dedication requirements which would apply <br /> to the proposed Living waters Church. <br /> in review of the Subdivision Ordinance, the following provisions <br /> appear applicable to the subject development request. <br /> Section 1001.14: <br /> The developer (subdivider of land) shall dedicate to the <br /> City land for public use as parks, playgrounds, trails or <br /> other open space. <br /> Section 1001.08, Subd. 4 (3) : <br /> Easements for pedestrian and bicycle trails shall be <br /> provided in accordance with the City' s adopted Trails <br /> Plan The exact location of trails can be determined <br /> by the developer with review and approval of the Park <br /> Board, Design Review Board, and City Council . <br /> Based on the above Ordinance provisions, it would appear that all <br /> subdivisions of land, including the subdivision necessary to <br /> accommodate the church, are to be subject to park dedication (cash <br /> and/or land) .
