3.General Provisions VI <br /> §1007.049 DRAINAGE. <br /> (1) No land shall be developed or altered and no use shall be permitted that results in surface <br /> water runoff causing unreasonable flooding,erosion or deposit of minerals on said land,adjacent <br /> properties or water bodies. Such runoff shall be properly channeled into a storm drain,a natural <br /> water course or drainageway,a ponding area or other public facility. <br /> (2) For all construction,erosion control measures must be in place prior to the beginning of <br /> site work,e.g.,grading,stripping,or construction. <br /> (a) The City may withhold inspections or suspend work on a site that does not have an <br /> approved grading plan or in-place erosion control measures. <br /> (b) The City may require financial security to insure placement of erosion control <br /> measures. <br /> (3) The owner or contractor of any natural drainage improvement or alteration may be <br /> required by the City Engineer to obtain recommendations from the Minnesota Department of <br /> Natural Resources, the Soil Conservation District, U.S. Army Corps of Engineers, affected <br /> watershed district(s),and/or City Engineer. <br /> (4) On any slope in excess of eight(8)percent where,in the opinion of the City Engineer, <br /> the natural drainage pattern may be disturbed or altered, the City Engineer may require the <br /> applicant to submit both a grading plan and soil conservation plan prior to applying for a building <br /> permit. <br /> (5) All agricultural, residential, commercial, and industrial developments shall be in <br /> accordance with applicable recommendations of the City's local water management plan as may <br /> be amended. <br /> (6) As part of a building permit application in which new structures or building footprint <br /> expansion of existing structures are proposed,a site survey showing proposed grading,drainage <br /> and building pad elevation(s) must be submitted to the City along with a certification by a <br /> registered land surveyor or engineer that they are consistent with the grading and drainage plan <br /> approved with the final plat or site plan. <br /> (7) Prior to issuance of an occupancy permit,the person or entity who developed,graded and <br /> constructed improvements upon the property for which the occupancy permit is requested,must <br /> submit certification by a registered land surveyor or engineer that the final grading,drainage and <br /> building pad elevations are consistent with the approved grading and drainage plan approved with <br /> the subdivision or site plan,or if no such City approved drainage and grading plan for the entire <br /> subdivision exists,that such person or entity represents that the grading,drainage and building pad <br /> elevations are consistent with the requirements of§1007.050(1)through§1007.050(5). <br /> 3-83 <br />
