3.General Provisions VI <br /> §1007.051 FARMING OPERATIONS. <br /> All farms in existence upon the effective date of this ordinance and all farms which are brought <br /> into the city by annexation shall be a permitted use. All dwelling units and structures for <br /> processing of farm goods shall require a building permit and conform to all requirements of the <br /> Building Code. The City Council may require any new farm operation to secure a conditional use <br /> permit in the event of the following: <br /> (1) The farm is adjacent to or within four hundred(400)feet of any dwelling unit and may <br /> be detrimental to living conditions by emitting noise,odors,vibrations,hazards to safety,and the <br /> like. <br /> (2) The farming operations are so intensive as to constitute an industrial type use consisting <br /> of the compounding, processing, and packaging of products for wholesale or retail trade and <br /> further that such operations may tend to become permanent industrial type operation that cannot <br /> be terminated as can a normal farming operation. <br /> 3-89 <br />
