If PID# 05-31-22-22-0006 were to be sold and/or not remain under common <br /> ownership, the maximum number of allowed animal units on the Subject Site <br /> would be reduced to 21.0. <br /> (e) Buildings housing domestic livestock, including barns, stables, sheds, and <br /> similar facilities shall be located no nearer than 100 feet from any inhabited, <br /> neighboring dwelling. <br /> Barns, stables and sheds on the property are located more than 300 feet away <br /> from the inhabited neighboring dwelling. <br /> Findings of Fact-Variance <br /> No variance shall be granted unless it meets all the criteria in paragraphs 1. through 7. <br /> below. The City shall make findings regarding compliance with these criteria. <br /> Per the May 11, 2021 Applicant's Variance Narrative Letter, the property owner provides <br /> the following findings: <br /> 1. The variance shall be in harmony with the general purposes and intent of the <br /> ordinance. <br /> The variance being sought is in conformance with the general purposes and intent of the <br /> ordinance. The City Code, at § 1007.080(1), states the purposes for the rural zoning <br /> district. These purposes include: <br /> a. To preserve productive land for agricultural use and maintain `open space' within <br /> and near to urban areas. <br /> c. To provide a method by which the urban farm can be guided so as to control <br /> urban sprawl and still conserve land in an economic status until such time as the <br /> need is present for an amendment to the Comprehensive Plan. <br /> The Property will continue to be maintained as an open space. The Property will <br /> continue to stand as a bulwark against urban sprawl. Moreover, it is noteworthy that for <br /> veterinary hospitals (a conditional use in this zoning district)up to forty(40) animals may <br /> be boarded on a property irrespective of its size. See City Code § 1007.080(7)(e). <br /> Horses boarded on the Property include geriatric and sick horses that receive care beyond <br /> that required for ordinary horses. The Property is substantially larger than a veterinary <br /> clinic. <br /> Staff Comment:A veterinary hospital is allowed up to 40 animals such as dogs and cats; <br /> not 40 animal units such as horses and cows. <br /> 2. The variance shall be consistent with the comprehensive plan. <br /> 13 <br />
