15. No manure waste shall be stored or spread within 50 ft of a wetland. <br /> a. A 50 ft wide vegetated wetland buffer shall be maintained. <br /> 16. No manure shall be spread on pastures with more than 1 horse per 2 acres. <br /> 17. Any future improvements required for restrooms shall be ADA compliant. <br /> 18. The number of portable animal shelters or loafing sheds on the Property shall be <br /> limited to six (6). <br /> a. The total combined square footage of the portable animal shelters or loafing <br /> sheds shall not exceed 1,200 sf. <br /> 19. The Property is subject to City Ordinance Chapter 503, Animal Control Regulations <br /> and shall be in compliance at all times. <br /> 20. A building permit or zoning permit is required for all future building construction or <br /> portable animal shelters. <br /> 21. The commercial stable operations shall be contained within the Property. <br /> a. Horseback riding in or along any road right-of-way shall be kept to a <br /> minimum. <br /> b. Animal waste deposited in or along any road right-of-way shall be removed <br /> immediately. <br /> 22. The City may inspect the Property on an annual basis. <br /> 23. Any violations of the conditional use permit or other city, state or regional regulations <br /> may result in revocation of the conditional use permit. <br /> Variance <br /> 1. The Subject Site consists of three (3)parcels (PID #05-31-22-22-0006, #05-31-22-22- <br /> 0003 and#05-31-22-22-0005). <br /> 2. The Property consists of two (2)parcels (PID #05-31-22-22-0003 and RID #05-31- <br /> 22-22-0005). <br /> 3. If any of the three (3) Subject Site parcels are sold or not held under common <br /> ownership, the variance is void. <br /> 4. A maximum of fifty(50.0) animal units are allowed on the Subject Site with an <br /> approved facility management and waste handling plan. <br /> 5. No more than two (2.0) of the fifty(50.0) animal units are allowed on RID #05-31- <br /> 22-22-0006. <br /> 6. The property owner shall work with the Minnesota Pollution Control Agency <br /> (MPCA) in creating an approved facility management and waste handling plan. <br /> a. If the facility management and waste handling plan requires off-site storage of <br /> manure waste, a written and signed agreement with an off-site property owner <br /> shall be submitted to the City annually. <br /> i. The agreement shall detail the number of times manure waste will be <br /> removed from the site and how much waste will be removed. <br /> b. An approved facility management and waste handling plan shall be submitted <br /> to the City within six (6) months of Council approval of the conditional use <br /> permit. <br /> 7. The Variance Council resolution shall be recorded against the Subject Site parcels by <br /> the City. <br /> 17 <br />
