potentially dangerous dog set forth in Minnesota Statutes Section 347.50 or any <br /> successor statute. <br /> A Potentially Dangerous Dog. "Potentially Dangerous Dog" means any dog that: <br /> (1) when unprovoked, inflicts bites on a human or domestic animal on public or <br /> private property; <br /> (2) when unprovoked,chases or approaches a person upon the streets, <br /> sidewalks, or any public property in an apparent attitude of attack; <br /> (3) has a known propensity, tendency, or disposition to attack Unprovoked, <br /> causing injury or otherwise threatening the safety of humans or domestic <br /> animals. <br /> Subd 10 Kennel, commercial. Any structure or premises on which four(4) or more dogs <br /> or cats , of one species,over six(6) months of age are kept, owned, boarded, <br /> groomed, sheltered,protected, bred,or offered for sale or any other merchandising <br /> that is not defined as a private kennel under Subd 11. Every commercial kennel <br /> shall be enclosed or fenced in such manner as to prevent the running at large or <br /> escape of animals confined therein. After issuance of a Conditional Use Permit, <br /> Commercial Kennels shall be allowed in the following zoning districts: Rural (R, <br /> R-X), Commercial(GB, CB), Industrial(LI,GI) <br /> Subd 11 Kennel, private. Any structure or premises on which between four(4)and six(6) <br /> ~' dogs or cats, of one species,over six(6)months of age are kept for private <br /> enjoyment and not for monetary gain. Every kennel shall be enclosed or fenced in <br /> such manner as to prevent the running at large or escape of animals confined <br /> therein. Private Kennels shall be allowed in all zoning districts upon the issuance <br /> of a Conditional Use Permit. <br /> Subd 12 Owner. Any person, firm, corporation, organization, or department, possessing, <br /> harboring, keeping, having an interest in, or having temporary or permanent <br /> custody or control of an animal. <br /> Subd 13 Under Restraint. Controlled by a leash of not more than six(6) feet in length; <br /> under the voice or signal command of a competent person whose command the <br /> animal will obey immediately;or within the limits of its owner's premises.
