shall any endorsement or statement on any check or letter <br /> accompanying a check for payment of rent be deemed an accord and <br /> satisfaction, and Circle Pines may accept such check or payment <br /> without prejudice to Circle Pines's right to recover the balance <br /> of such rent or to pursue any other remedy provided in this <br /> lease. <br /> 13. HOLDING OVER. In the event Lino Lakes continues <br /> to occupy the premises after the last day of the term herein <br /> created, and Circle Pines elects to accept rent thereafter, a <br /> tenancy from year-to-year only shall be created. <br /> 14. CIRCLE PINES'S COVENANT OF TITLE AND QUIET <br /> ENJOYMENT. Circle Pines covenants and warrants that Circle <br /> Pines has full right and lawful authority to enter into the <br /> lease for the full term hereof and that Circle Pines is lawfully <br /> seized of the entire premises hereby demised and has good title <br /> thereto, free and clear of all tenancies and encumbrances, and <br /> that at all times when Lino Lakes is not in default under the <br /> terms and conditions of this lease, Lino Lakes's quiet and <br /> peaceable enjoyment of the demised premises shall not be <br /> disturbed or interfered with by anyone. <br /> 15. NOTICE. If at any time after the commencement of <br /> this lease, it shall become necessary or convenient for one of <br /> the parties hereto to serve any notice, demand or communication <br /> upon the other party, such notice, demand or communication shall <br /> be in writing, signed by the party serving same, deposited in <br /> -7- <br />
