In addition, nothing in <br /> this article shall prevent building on an existing lot of <br /> record, provided that such building shall be designed to save <br /> as many trees as possible. This decision shall be based on, <br /> but not . limited to the following criteria: <br /> 1. Size <br /> 2. Species, health and attractiveness of the trees, <br /> including: <br /> a. sensitivity to disease <br /> b. life span <br /> c. nuisance characteristics <br /> d. sensitivity to site grading <br /> 3 . Potential for transplanting <br /> 4. Need for thinning a woodlot <br /> 5. Effect on the functioning of a development <br /> C. Land Disturbance Permit <br /> 1. A tree protection plan shall be submitted with other <br /> permit drawings as part of the land disturbance permit <br /> process. An application fee shall be established by the City <br /> Council by resolution from time-to-time. This plan may <br /> either be a separate drawing, or part of the landscape plan, <br /> and shall include the following information. <br /> a. Definition of spatial limits. <br /> 1. Limits of land disturbance, clearing, grading and <br /> trenching. <br /> 2 . Tree protection zones. <br /> 3 . Specimen trees or stands of trees. <br /> b. Detain drawings of tree protection measures (where <br /> applicable) . <br /> 1. Protective tree fencing. <br /> 2 . Tree protection signs. <br /> 2 . These plans shall be reviewed by the City Forester for <br /> conformance with Tree Preservation Standards and <br /> administrative guidelines, and will either be approved, or <br /> returned for revisions. Reasons for denial shall be noted <br /> on the tree protection plan, or otherwise stated in writing. <br /> 3 . Issuance of the land disturbance permit is contingent <br /> upon approval of the tree protection plan. <br /> 4. City Staff may submit the plan to a consulting forester <br /> for a recommendation. Any costs shall be paid for by the <br /> developer or builder. <br /> 5. All tree protection measures shall be installed prior to <br /> land disturbance, . and inspected by the City Forester. <br /> 6. The City Forester will conduct follow-up site inspections <br /> for enforcement of the Tree Preservation Ordinance and its <br /> administrative standards. <br /> 7. If large trees are cut the density of trees shall be <br /> restored to that which existed before soil disturbance but in <br /> no case shall the applicant be required to raise the density <br /> above ten (10) trees per acre, unless part of a required <br /> planting screen. <br /> 8.
