It would be my recommendation <br /> that the areas the City desires for trail be labeled as park on <br /> the final plat so that the City has control over these areas for <br /> park purposes which would include trailways. I don' t believe <br /> the County Surveyor will accept easements for anything other <br /> than public utilities, drainage, or streets on a plat. <br /> Similarly merely labeling them as outlots would require the <br /> developer, after approval of the final plat and recording <br /> thereof, to convey the property to the City by separate warranty <br /> deed. <br /> Any time land is dedicated in a plat the City has an easement <br /> over the property for park purposes. This would give the City <br /> absolute control over the premises and would allow us to pro- <br /> hibit the adjoining property owners from constructing fences- or <br /> planting trees on the trails. <br /> If you have any further questions regarding this matter, please <br /> contact me. <br /> S ' n erely, <br /> elliam G.
