All builders in new housing projects shall submit a tree <br /> protection plan to the City to be reviewed as part of their <br /> normal building permit procedure. This plan must be approved <br /> by the City Forester or Assistant and physical barriers <br /> installed before any construction of said building or house <br /> proceeds . <br /> The tree protection plan must cover all areas of preventing <br /> construction damage including the designation of utility <br /> alleys, cut and fill areas, tree felling, tree wounding, tree <br /> protection zones , and devise control , and any other acres <br /> thought to be necessary by the City Forester. <br /> No person shall deposit , place, store, or maintain upon any <br /> public place of the municipality, any stone, brick, sand, <br /> concrete, or other materials which may impede the free <br /> passage of water, air, fertilizer to the roots of any tree <br /> growing therein, except by written permit of the Municipal - <br /> Forester. <br /> SECTION XV VIOLATION AND PENALTY <br /> Any person violating any provisions of this ordinance shall <br /> be guilty of a misdemeanor. <br /> SECTION XVI LEGALITY OF ORDINANCE AND PARTS THEREOF <br /> Should any section, clause, or provisions of this Ordinance <br /> be declared by the Courts to be invalid, the same shall not <br /> affect the validity of the Ordinance as a whole, or' parts <br /> thereof, other than the part so declared to be invalid. <br /> SECTION XVII EMERGENCY <br /> This Ordinance is hereby declared to be of immediate <br /> necessity for the preservation of public peace, health, and <br /> safety, and shall be in full force and effective from and <br /> after its passage and publication as provided by law. <br /> Passed this --------- day of ------------------ 19 <br /> Signed this --------- day of -----------------, 19 <br /> ----------------------------------------- <br /> Harold L.
