7^\ <br /> MEMORANDUM <br /> TO: Honorable Mayor, City Councilmembers , Park <br /> Boardmembers , Randy Schumacher, John Miller, Don <br /> Volk <br /> FROM: Laura Elken, Planning Secretary <br /> DATE: September 12, 1989 <br /> SUBJECT: Park Dedication for Commercial/Industrial _ <br /> Companies <br /> During the last two years I have been askedto survey area <br /> cities for a number of different requests. This has been the <br /> most interesting. The cities I contacted were as follows : <br /> Vadnais Heights <br /> Blaine <br /> Oakdale <br /> Shoreview <br /> Maplewood <br /> In visiting with the city planner at each of these cities I <br /> asked them how they would handle park dedication for <br /> commercial and industrial businesses that bought a parcel of <br /> land, did not plat or subdivide the land, and simply built <br /> their structure on a parcel . <br /> Before I begin to tell you what their response was , I have to <br /> explain that with each city we discussed the fact that under <br /> the Minnesota Statutes chapter 462. 358 Subd. 2b it states <br /> that park dedication can be claimed only when land has been <br /> subdivided. It states : <br /> Dedication. The regulations may require that a <br /> reasonable portion of any proposed subdivision be dedicated <br /> to the public or preserved for public use as streets, roads, <br /> sewers, electric, gas, and water facilities, storm water <br /> drainage and holding areas or ponds and similar utilities and <br /> improdements. <br /> In addition, the regulations may require that a <br /> reasonable portion of any proposed subdivision be dedicated <br /> to the public or preserved for public use as parks, play— <br /> grounds, trails, or open space; provided that (a) the <br /> municipality may choose to accept to be dedicated to such <br /> public uses or purposes based on the fair market value of the <br /> Page 1 <br />
