3
MEMORANDUM
TO: All Park Board Members
FROM: Marty Asleson
DATE: April 2, 1992
SUBJECT: Parkview Estates Easement
Ray Johnson asked me to check into an easement between lots 9 and
r1 10 on block 2 of Parkview Estates. This is a Keith Eibensteiner
development.
In researching this easement with the County Recorder's Office, it
was discovered that it was recorded within the plat as a drainage
and utility easement "donated and dedicated to the public", the
same as all the easements in that plat were recorded.
The legal description reads the so. 15 ft. of lot 10, and the no.
15 ft. of lot 9. This is document #881 949 filed on February 14,
1990 at the Anoka County Courthouse.
There are trees that would need to be removed to now place the
trail in. There are also two houses next to where the trail must go
in. The developer (Keith Eibensteiner) has told me that both
property owners know that there is a trail that will go through to
the park. I notified Eibensteiner that the deed and the plat need
to be changed appropriately. He said he will get back to me. At
this time I have no further information and will bring anything new
to the park board meeting.
