MEMORANDUM <br /> TO: All Park Board Members <br /> FROM: Marty Asleson <br /> DATE: January 3, 1992 <br /> SUBJECT: Background information regarding the concerns of <br /> Mr. Robert Appleby, 214 Woodridge Ct. and Mr. John <br /> Kuny, 212 Woodridge Ct. <br /> Some time ago after I had just started working for the City of Lino <br /> Lakes, it was brought to my attention at a Park Board meeting that <br /> there had been a trail dedication in the Woodridge Estates <br /> development, and it was further pointed out that these trails had <br /> not yet been rough-graded in. Mr. Richard Carlson, the developer, <br /> was immediately notified of our concerns of having these trails <br /> roughed-in before housing occurred around them. He assured us that <br /> there was plenty of time to rough these trails in and that he would <br /> start working immediately to have the plat corrected to include <br /> trails. Since it was late Fall, Mr. Carlson felt it would be better <br /> to wait for Spring to rough the trails in. <br /> By the next Spring, one house had been built next to the agreed <br /> upon trail location at 212 Woodridge Ct. , this was the Kuny <br /> residence. After discovering a house next to the dedicated, non- <br /> plat indicated trail (we have deeds to these trails) had been <br /> built, Mr. Carlson was again notified and he decided that now his <br /> decision was to move the trail to the other side of the 20' <br /> easement. (further away from Mr. Kuny's house, but closer to the <br /> soon to be built house at 214 Woodridge Ct. , Mr. Bob Appleby) After <br /> the Appleby house was completed, Mr. Carlson then proceeded to <br /> rough-in the trail. <br /> Mr. Appleby and Mr. Kuny then contacted the City in order to find <br /> out what the City was doing. These folks had no idea that there was <br /> to be any sort of trail next to their houses. They further stated <br /> that their builder had not notified hem of these trails, that the <br /> plat did not indicate the presence of these trails, and that their <br /> title companies also did not show evidence of these trails. <br /> Staff then met with the property owners, the builder and the <br /> developer in an attempt to resolve the issue and possibly relocate <br /> this trail. This trail also happens to be an important link in the <br /> system since all other corridors leading into the Regional Park for <br />
