I know you are aware of it as well as the <br /> problems that have arisen because of it. <br /> I am not satisfied with its presence and would like to see it <br /> removed as soon as possible. We purchased our lot from our <br /> builder, Tony Palaia, on August 10, 1990. My wife and I, <br /> along with Tony Palaia and his surveyor reviewed the plat <br /> drawings, legal land description and papers provided by you <br /> We learned of covenants, easements and restrictions <br /> pertaining to the lot and were aware of drainage and utility <br /> easements along the south side of our lot. We decided the <br /> lot fit our needs and even reversed our house plan and placed <br /> our deck on the south side to maximize its potential. <br /> Mr. Carlson, we feel you are responsible for this unpleasant <br /> situation for the following reasons: <br /> 1. The plat drawings provided by you to the builders are <br /> different than the one we recently obtained from the <br /> City of Lino Lakes. We, in good faith, believed you <br /> were providing us with correct documents. <br /> 2. We have learned from John Miller, Lino Lakes City <br /> Planner, that it was your responsibility to install <br /> the walking path before any lots were sold. You were <br /> negligent in doing this. <br /> Had we known of the walking path we certainly would not have <br /> purchased this lot. Because of the path, we have lost much <br /> of what we found appealing from the start. We now have a <br /> deck that will face a public path which leaves us with a loss <br /> of privacy and security. We lost sod that we put down to <br /> make our property more attractive and the value of our home <br /> is reduced significantly. <br /> We do not want this walking path to remain on our property. <br />
