Carlson Carlson, Dropps & Associates, Inc. 7671 Old Fridley Ave. Fridley, MN 55432 Dear Mr. Carlson, This is to advise you, of a problem relating to our property in Woodridge Estates. Last December my wife and I entered into an Agreement with Meridian Homes to build our present home. The cul-de-sac location we chose, although premium priced, offered maximum privacy (and security) which were primary factors in our lot selection process. We then chose a custom home design and, modified it at additional expense to further optimize privacy. As Woodridge Estates developer, your Company approved the building plan for our home. We closed and moved into our new home in April of this year. At that time we were aware of all easements including one along the northeast property line. But, as stated in Article II of the Woodridge Estates Covenants, we understood easements were for underground utilities and if opened, required the surface to be "restored to its former condition" . Approximately two months after we moved into the home, your work crew arrived, and without notice cut and installed a dirt trail along our northeast property line. This trail intrudes about three feet into both our lot and that of our neighbor. We contacted our builder, John Feges of Meridian who, after checking into the situation, advised us this was part of a nature trail system. John said that he was not previously aware of any trail plan that would affect our property site. We have had several meetings with City of Lino Lakes Officials and have established: a. You were aware of the nature trail plan before any lots were sold in Woodridge Estates. b. You were responsible for installing the trails C. The trails should have been installed before the lots were sold. Then, the potential property owner would be aware of them and, have the option to select or reject the site.
