Carlson <br /> Carlson, Dropps & Associates, Inc. <br /> 7671 Old Fridley Ave. <br /> Fridley, MN 55432 <br /> Dear Mr. Carlson, <br /> This is to advise you, of a problem relating to our property in <br /> Woodridge Estates. <br /> Last December my wife and I entered into an Agreement with Meridian <br /> Homes to build our present home. The cul-de-sac location we chose, <br /> although premium priced, offered maximum privacy (and security) <br /> which were primary factors in our lot selection process. We then <br /> chose a custom home design and, modified it at additional expense <br /> to further optimize privacy. As Woodridge Estates developer, your <br /> Company approved the building plan for our home. <br /> We closed and moved into our new home in April of this year. At <br /> that time we were aware of all easements including one along the <br /> northeast property line. But, as stated in Article II of the <br /> Woodridge Estates Covenants, we understood easements were for <br /> underground utilities and if opened, required the surface to be <br /> "restored to its former condition" . <br /> Approximately two months after we moved into the home, your work <br /> crew arrived, and without notice cut and installed a dirt trail <br /> along our northeast property line. This trail intrudes about three <br /> feet into both our lot and that of our neighbor. We contacted our <br /> builder, John Feges of Meridian who, after checking into the <br /> situation, advised us this was part of a nature trail system. John <br /> said that he was not previously aware of any trail plan that would <br /> affect our property site. <br /> We have had several meetings with City of Lino Lakes Officials and <br /> have established: <br /> a. You were aware of the nature trail plan before any lots <br /> were sold in Woodridge Estates. <br /> b. You were responsible for installing the trails <br /> C. The trails should have been installed before the lots <br /> were sold. Then, the potential property owner would be <br /> aware of them and, have the option to select or reject <br /> the site. <br />
